1. Introduction.

(a) Website Owner. BSI is the owner of this Website. BSI can be contacted by mail at 17550 Gilette Ave, Irvine, CA 92614, by phone at 714-258-4500, or by e-mail at privacy@bisearch.com. This Privacy Notice discloses BSI’s information and privacy practices for this Website, including what type of personally identifiable information is requested in order to communicate with consumers, how the information is used, and with whom the information is shared.

(b) Anonymous Website Visits. In general, you can visit the Website without disclosing any Personal Information. However, BSI keeps track of the domains from which people visit us. BSI may need to collect the consumer's name, phone number, and e-mail address. It is BSI’s intent to inform you before BSI collects Personal Information, such as the user's name and/or address on the internet. If you choose not to opt-in to this collection of Personal Information, BSI will respect your wishes. However, please note that if you do not opt-in to this collection, BSI may be unable to process any transactions through the Website.

2. Personal Information That May Be Collected.

This Privacy Notice covers our treatment of your personally identifiable information. “Personal Information" generally refers to any unencrypted or non-deidentified information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person. However, the definition of Personal Information may vary depending on the state in which you reside, and that state or country’s definition will apply to your Personal Information in the context of this Privacy Notice.

Personal Information does not include information publicly available from government records or information excluded by applicable law. Personal Information also does not include your Personal Information that has been deidentified, pseudonymized, anonymized, aggregated, and/or otherwise processed so as to be unidentifiable in such a way that the data can no longer be attributed to a specific individual (by reasonable means) without the use of additional information, and where such additional information is kept separate and under adequate security to prevent unauthorized re-identification of a specific individual such that one could not, using reasonable efforts, link such information back to a specific individual.

We also may collect Personal Information from you through means other than our Website. This may include offline collection, such as if you submit a paper application, make a payment by check, or call or visit our office. It also may include emails, text messages, or other electronic communications that you send to us separate from our Website. However, if we combine the Personal Information we collect from you outside of our Website with Personal Information that is collected through our Website or by another means as described above, the Privacy Notice will apply to the combined information unless specifically disclosed otherwise.

This Privacy Notice also applies to personal information we collect about individuals with whom we have a business relationship.

Other than as stated herein, this Privacy Notice does not apply to information collected by any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on our Website. We are not responsible for the practices of sites linked to or from the Website, and before interacting with any of the sites, you are advised to review their rules and policies before providing them with any private information.

Some of the information about you may include Personal Information that can be used to identify you, like name, address, and email address. In certain states, the definition of personal information may be broader and include things like IP address, mobile device ID, and unique identifiers used by cookies. When the information we collect about you is considered personal information under applicable law, we treat it as Personal Information.

Personal Information does not include data where your identity has been removed so that we can no longer identify you or that we aggregate so that you can no longer be identified, which we may use for any purpose.

(b) Service Quality Monitoring. Some Website communications may require a consumer to telephone BSI, or BSI to call the consumer. BSI will not contact you by telephone without your prior consent. Consumers should be aware that it is BSI's practice to monitor and, in some cases, record such calls for staff training or quality assurance purposes.

(c) Information from Children. Under no circumstances shall BSI knowingly collect or maintain information from users under the age of 13, and no part of BSI's Websites is structured to attract anyone under the age of 13. If you believe your child has provided Personal Information to us, please contact us at privacy@bisearch.com, and we will work to delete it.

(d) Links to Other Websites. BSI’s Website may contain links to other websites. BSI is not responsible for the privacy practices or the content of those other websites.

4. Uses Made of the Information.

(a) Limited Uses Identified. Without the consumer's prior express consent, BSI will not use personally identifiable information for any purpose other than that for which it is submitted. BSI may use personally identifiable information to reply to inquiries, handle complaints, provide operational notices, and for in program record-keeping. BSI also processes billing and business requests related to BSI Website participation. Personal Information collected by BSI may also be used for the following purposes: statistical analysis of consumer's behavior; product development; content improvement; to customize the content and layout of BSI's Website; for internal company reviews; and for legal purposes.

(b) Marketing Uses. If the consumer marks on the opt-in option box herein provided, BSI reserves the right to provide the consumer with information about BSI's Website, BSI products and services, and related information in which the consumer has indicated an interest. Once the Personal Identifying information is aggregated and thereby becomes non-identifying, the identifying information is retained only as required for transaction-related purposes.

(c) Stored Information Uses. With the consumer’s consent, BSI stores and retains the information provided by the consumer. This information is used to compile a consumer's purchase history in order to enable BSI to recommend products, services, or special offers that would be of interest to a consumer. This information is also used by BSI to support consumer interaction with the BSI Website and/or to contact the consumer again about other BSI services and products.

(d) Online Advertising. Some companies that help BSI deliver interactive online advertising, such as banner ads, may collect and use information about BSI's consumers to help BSI better understand the types of advertising or promotions that are most appealing to BSI's consumers. After it is collected, the information is aggregated so it is not identifiable to a specific individual. If, however, the consumer would prefer that these companies not collect such information, please do not mark the opt-in option box herein provided.

5. Disclosure of the Information.

(a) Within Corporate Organization. BSI is a multinational organization, with legal entities, business processes, management structures, and technical systems that are located in cross borders. BSI may share your Personal Information within the BSI corporate organization and may transfer the information to countries in the world where BSI conducts business. Some countries may provide less legal protection for consumer Personal Information. For California consumers, BSI will still handle consumer Personal Information in the manner described herein.

(b) Mergers and Acquisitions. Circumstances may arise where, for business reasons, BSI decides to sell, buy, merge, or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers and/or receiving such information from sellers. It is BSI's practice to seek appropriate protection for information in these types of transactions, including honoring consumer requests to delete their Personal Information before the merger and acquisition.

(c) Agents. BSI employs or engages other companies and individuals to perform business functions on behalf of BSI. These persons are provided with personal identifying information required to perform their functions but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions, which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from consumer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing consumer services.

(d) Marketing Analysis by Third Parties. BSI reserves the right to disclose to third parties Personal Information about consumers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual consumer.

(e) Disclosure for Legal Reasons. Under certain circumstances, Personal Information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants, or orders. BSI releases personal identifying information when BSI reasonably believes release is appropriate to comply with law, to enforce BSI agreements, or to protect the rights, property, or safety of BSI consumers. BSI may also release such information in an exchange of information with other companies and/or organizations for the purposes of fraud protection and credit risk reduction.

6. Use of Computer Tracking Technologies.

(a) No Tracking of Personal Information. The Website is not set up to track, collect or distribute Personal Information not entered by visitors. Through website access logs, BSI does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis, and business decision-making, all of which provide better services to the public. The statistics garnered, which contain no Personal Information and cannot be used to gather such information, may also be provided to third parties.

(b) Use of Cookies. BSI, or its third-party vendors, collects non-identifiable and Personal Information through the use of various technologies to provide easier site navigation, including "cookies." A cookie is an alphanumeric identifier that a website can transfer to a consumer's hard drive through the consumer's browser. The cookie is then stored on the consumer's computer as an anonymous tag that identifies the consumer's computer, but not the consumer or the consumer’s Personal Information. The cookies may be sent by BSI or its third-party vendors. The consumer can set its browser to notify the consumer before a cookie is received, giving an opportunity to decide whether to accept the cookies. The consumer may also set its browser to turn off the cookies; however, some Websites may not then work properly.

(c) Collection of Non-Identifiable Information. BSI may collect non-identifiable information from user visits to the BSI Website in order to provide better consumer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on BSI Website; Website and system administration; user analysis; and business decision making. Such information is sometimes known as "clickstream data." BSI or its contractors may use this data to analyze trends and statistics.

(d) Collection of Personal Information. BSI collects personal identifying information from the consumer during a transaction. BSI may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help BSI understand trends and patterns. This information is not reviewed at an individual level.

7. Information Security.

(a) Commitment to Online Security. BSI employs reasonable physical, electronic, and managerial procedures to safeguard the security and integrity of Personal Information. Personal Information is accessible only by staff designated to handle online requests or complaints.

(b) No Liability for Acts of Third Parties. BSI will exercise all reasonable efforts to safeguard the confidentiality of consumer Personal Information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, BSI shall not be liable for unauthorized disclosure of Personal Information due to no fault of BSI, including but not limited to, errors in transmission and unauthorized acts of third parties.

8. Data Retention.

We retain your Personal Information for as long as necessary to fulfill the purpose(s) for which the information was collected, depending on the purpose(s) for which the information was collected, the nature of the information, any contractual relationship that may govern the retention of the information, and our legal or regulatory obligations. We will destroy your Personal Information if you submit the request to delete. We will retain Usage Data for analytics purposes. “Usage Data” refers to data collected automatically.
